——-Moves Prerogative of Mercy Secretariat to Justice Ministry, Orders Review Guidelines

The President and Commander-in-Chief of the Armed Forces, Asiwaju Bola Ahmed Tinubu has signed the official instruments granting clemency and pardon to certain individuals previously convicted for various offences, exercising his constitutional powers under Section 175 (1) and (2) of the 1999 Constitution (as amended).

According to a statement by the Special Adviser to the President on Information and Strategy, Bayo Onanuga, the move followed extensive consultations with the Council of State and consideration of public opinion.

However, President Tinubu ordered a further review of the initial list of beneficiaries, directing the removal of individuals convicted of serious crimes such as kidnapping, drug trafficking, human trafficking, fraud, and unlawful possession of firearms. Some others on the old list had their sentences commuted rather than fully pardoned.

The President’s decision, the statement explained, was informed by the gravity of certain offences, national security implications, and the need to respect the feelings of victims and society at large. He emphasized the principle of justice as a “three-way traffic” involving the accused, the victims, and the state.

The updated list of approved beneficiaries has been forwarded to the Nigerian Correctional Service for immediate implementation in accordance with the signed instruments of release.

In a significant administrative reform, President Tinubu also directed the relocation of the Secretariat of the Presidential Advisory Committee on Prerogative of Mercy from the Federal Ministry of Special Duties to the Federal Ministry of Justice.

Additionally, the Attorney-General of the Federation has been directed to develop new guidelines for the exercise of presidential mercy, including mandatory consultation with relevant prosecuting agencies to ensure transparency and adherence to due process.

President Tinubu however expressed his profound appreciation for the constructive feedback from the citizens and stakeholders, reiterating his administration’s commitment to comprehensive judicial reforms and the enhancement of Nigeria’s justice system.
