The National Commission for Persons with Disabilities (NCPWD) has issued a stern warning to airlines operating in Nigeria over alleged discriminatory practices against persons with disabilities, vowing to pursue legal action against any carrier found in violation of the law.

In a press release on Tuesday, the Commission expressed deep concern over reports that some airlines have refused to airlift persons with disabilities, particularly on what the operators describe as “small travel jets.” The NCPWD described the practice as a clear infringement on the rights of persons with disabilities and a breach of both national and international regulations.

According to the Commission, such actions run contrary to global aviation standards and Nigeria’s legal framework on disability rights. It cited the Discrimination Against Persons with Disabilities (Prohibition) Act, 2018, which mandates all airlines operating in Nigeria to ensure full accessibility of their aircraft to persons with disabilities and to accord them priority during boarding and disembarkation.

“Noncompliance with these provisions will definitely attract sanctions as enshrined in the law,” the Commission warned, stressing that accessibility and inclusivity are not optional but legal obligations.

The NCPWD further referenced international best practices as prescribed by the International Air Transport Association (IATA), urging airlines to align their operations with standards that promote equal access and non-discrimination for all passengers.

Describing the reported denial of boarding as “disappointing and unacceptable,” the Commission said such actions undermine Nigeria’s commitment to inclusivity, especially following the passage of the landmark 2018 Prohibition Act.

“The Commission will view any oversight in this regard as an infringement on the rights of persons with disabilities,” it said, adding that repeated complaints, inconveniences, and distress suffered by affected passengers risk rendering the law ineffective in practice.

The NCPWD also noted that discrimination against persons with disabilities represents a significant setback to efforts aimed at promoting accessibility and inclusivity within the aviation sector and beyond.

“As an organization committed to the rights and empowerment of persons with disabilities, we believe accessibility must be a top priority in all aspects of life, including air and land transportation,” the statement read.

The Commission called on relevant regulatory authorities to investigate the reported incidents and ensure concrete measures are implemented to prevent future occurrences. It also appealed to industry stakeholders and the general public to support the drive for a more inclusive and accessible Nigeria.
